Leaders unite across party lines to defend Constitution from NDAA – Tenth Amendment Center

In the first few weeks of 2012, at least six jurisdictions have enacted local resolutions opposing the military detention provisions of the controversial National Defense Authorization Act (NDAA) signed into law by the president only a few weeks ago. Meanwhile, legislation to nullify the NDAA has been introduced in legislatures of several states from coast-to-coast, with a Virginia bill passing the House of Delegates 96-4 last week.

Virginia votes to refuse NDAA — RT

Although Congress approved this year’s National Defense Authorization Act, lawmakers on another level continue to find faults with its nasty detainment provisions. Virginia is now the latest state to consider laws that nix some of the NDAA.

When US President Barack Obama signed his name to the National Defense Authorization Act for Fiscal Year 2012, he authorized the US military to detain and torture anyone on Earth — Americans included — without charge. Opposition was widespread even before the commander-in-chief put pen to paper, but critics are continuing to condemn the legislation only two months after Obama approved it. So weary of the NDAA are lawmakers in Virginia, in fact, that a recent vote within the state’s House of Delegates led to the passing of a counter-act that will keep those detainment provisions out of VA.

From Obama, What Next?

We have witnessed President Barack Obama, and his administration, issue edicts, work against and/or ignore the US Constitution and Congress, and be inconsistent when it suits him.  The question now becomes, "What will Obama do next?"

In August, 2011, Health and Human Services (HHS) Secretary Kathleen Sebelius issued a proposed regulation that would force all health care plans to cover sterilizations and contraceptives, including those that cause abortion.  On January 20, 2012, Sebelius announced that the final regulation would take effect for individuals and business owners on August 1, 2012, and for Catholic hospitals, universities and charities on August 1, 2013.

Pomeroy Daily Sentinel - National Defense Act goes against Bill of Rights

On December 31, President Obama signed into law the National Defense Authorization Act. Rep. Bill Johnson, as well as U.S. Senators Portman and Brown, voted for this bill. In a letter from Rep. Johnson, it seems he is unaware of what he helped legalize in this bill.

This law allows for the arrest and detention of American citizens by the U.S. military in violation of the U.S. Bill of Rights. Contracts are being issued for the construction of detention camps! Never in the history of the United States has the U.S. military ever been granted this radical legal power. Thomas Jefferson denounced the Sedition Act as invalid and a violation of the constitution. During the Civil War, the U.S. Supreme Court stopped the U.S. military from using this power. William O. Douglas said, “The Alien and Sedition Laws constituted one of our sorriest chapters; and I had thought we had [been] done with them forever.”

States march forward on anti-detention campaigns

The arguments still are raging over whether several provisions in a national defense appropriations act authorize warrantless detentions of American citizens who may be described by Washington as “belligerents,” but states aren’t waiting for any final determination.

The Virginia House already has passed – overwhelmingly – a “bill to prevent any agency, political subdivision, employee, or member of the military of Virginia from assisting an agency of the armed forces of the United States in the conduct of the investigation, prosecution, or detention of a citizen in violation of the United States Constitution, the Constitution of Virginia, or any Virginia law or regulation.”

Are you a potential terrorist under NDAA? | San Francisco Bay View

President Obama signed the National Defense Authorization Act on Dec. 31, 2011. The act allocates $662 billion to defense, which includes military equipment, naval vessels and aircraft, including drones for sale, transfer or loan to foreign countries. It details strategy reports and policy on counter-terrorism, detention, prosecution and United States interests abroad.

Critics of the NDAA have focused on Sections 1021, 1022 and 1023 that deal with counter-terrorism and allow the U.S. military to detain, arrest and interrogate U.S. citizens and legal residents without trial. Republican presidential candidate Ron Paul said, “Right now the battle against terrorism involves all of us, and everyone in this country is a potential terrorist.”
